Any content or interactions on Fun Park Go’s social media pages; and
Any mobile or web applications we may offer (collectively, the “Services”).

These Terms form an agreement between you and Fun Park Go (“Fun Park Go,” “we,” “us,” or “our”).

By using the Services, or by clicking to accept or agree to these Terms, you acknowledge that you have read, understood, and agreed to be bound by:

Ensuring anyone using your internet connection is aware of these Terms; and
Maintaining accurate account information.

If you create an account, you must:

Keep your login credentials confidential;
Not share access with any other person; and
Promptly notify us of any unauthorized use or security breach.

We may disable or refuse any username or account at our sole discretion.

5. INTELLECTUAL PROPERTY

The Services and all related materials—including text, graphics, images, videos, logos, software, and design elements (the “Content”)—are owned by Fun Park Go or our licensors and protected by U.S. and international intellectual property laws.

You may use the Services for:

Personal travel planning (non-commercial); and
Business purposes if you are a Fun Park Go independent travel advisor and have a written Advisor Agreement with us.

You may not:

Reproduce, distribute, modify, or create derivative works from the Content;
Use images or graphics separately from related text;
Remove copyright or proprietary notices;
Use Content for commercial purposes without written permission.

If you print, copy, or download material from the Website in violation of these Terms, your right to use the Services ceases immediately and you must destroy any unauthorized copies.

6. IMAGES & SUPPLIER MATERIALS

Some images on the Services—including resort photos, ship photos, destination images, and promotional materials—may be supplied by independent travel providers or Fun Park Go advisors (“Supplier Images”).

Unless we explicitly authorize otherwise in writing:

Only Fun Park Go and authorized Fun Park Go advisors may use Supplier Images for legitimate travel marketing purposes;
No other person or entity may copy, distribute, or use Supplier Images for any purpose.

Fun Park Go does not verify ownership or usage rights for Supplier Images. If you use such materials, you do so at your own risk and agree to indemnify Fun Park Go for any resulting claims.

7. TRADEMARKS

The Fun Park Go name, logo, and related branding elements are trademarks of Fun Park Go. You may not use these marks without our prior written permission.

All other trademarks appearing on the Website belong to their respective owners.

8. PROHIBITED USES

You agree not to use the Services:

For any unlawful purpose;
To exploit or harm minors;
To share content that violates our Content Standards;
To transmit spam or unauthorized promotions;
To impersonate Fun Park Go, a Fun Park Go advisor, or any other person;
To interfere with or disrupt the Website’s proper function;
To introduce viruses or other malicious code;
To attempt to gain unauthorized access to systems or servers; or
To perform automated scraping or data extraction without written permission.

9. USER CONTENT

Users may have access to interactive areas including reviews, comments, profiles, forums, surveys, or other features allowing you to post content (“User Content”).

By posting User Content, you grant Fun Park Go a perpetual, worldwide, royalty-free license to use, modify, reproduce, distribute, display, and create derivative works from your content for any lawful purpose.

You represent that:

You own the rights to the User Content you post;
Your content complies with these Terms; and
You bear full responsibility for your posted content.

Fun Park Go is not responsible for User Content and does not guarantee monitoring or removal of objectionable content.

10. CONTENT STANDARDS

User Content must NOT:

Be defamatory, obscene, hateful, or harmful;
Promote violence, discrimination, or illegal activity;
Infringe intellectual property rights;
Violate privacy or publicity rights;
Mislead or deceive;
Cause unnecessary distress or harassment;
Impersonate another person;
Contain unauthorized commercial promotions; or
Falsely imply endorsement by Fun Park Go.

11. COPYRIGHT COMPLAINTS (DMCA)

If you believe your copyrighted work has been used on the Services without authorization, you may file a Digital Millennium Copyright Act (DMCA) notice.

Fun Park Go does not guarantee accuracy, completeness, reliability, or timeliness. Any reliance on such information is at your own risk.

14. TRAVEL PROVIDERS, ADVISORS & INDEPENDENT CONTRACTORS

Fun Park Go does not provide, own, or control most of the travel services booked through our platform. Flights, hotels, cruises, rental cars, insurance, attractions, and tours are provided by independent third parties (“Travel Providers”).

Fun Park Go also works with independent travel advisors (“Advisors”). Advisors are independent contractors, not employees, not partners, and not agents of Fun Park Go.

You acknowledge and agree that:

Advisors operate independently and are solely responsible for the advice and services they provide;
Travel Providers are solely responsible for the travel products they supply;
Fun Park Go does not supervise or control an Advisor’s day-to-day work;
Advisors cannot make promises or commitments on behalf of Fun Park Go unless explicitly outlined in writing by Fun Park Go;
Fun Park Go is not liable for any acts, errors, omissions, representations, negligence, or misconduct of Advisors or Travel Providers;
Any disputes or issues regarding bookings, cancellations, delays, refunds, injuries, or service quality are between you and the applicable Advisor and/or Travel Provider.

This is one of the strongest independent-contractor shields you can include.

15. PURCHASES, PAYMENTS & CANCELLATIONS

You are responsible for all payments associated with travel products you purchase, including:

Fares
Fees
Taxes
Deposits
Penalties
Travel insurance

Prices and availability may change without notice. Currency fluctuations may impact international bookings.

Issues involving payments, refunds, or cancellations must be addressed directly with the responsible Travel Provider or Advisor according to their terms.

Fun Park Go is not responsible for Travel Provider policies or performance.

16. TRAVEL DOCUMENTS, ENTRY REQUIREMENTS & INSURANCE

You are solely responsible for:

Passports, visas, and entry requirements;
Vaccinations, health requirements, and medical documentation;
Complying with all government, airline, and destination regulations;
Reviewing travel advisories or health notices;
Obtaining sufficient travel insurance.

Fun Park Go, Advisors, and Travel Providers are not responsible for:

Denied boarding or denied entry;
Lost travel opportunities due to missing documentation;
Illness or injury while traveling;
Uninsured losses or expenses.

17. DISCLAIMER OF WARRANTIES

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

Fun Park Go makes no warranties regarding:

Accuracy or completeness of information;
Availability or reliability of the Website;
Performance or quality of any Travel Provider or Advisor;
Error-free or uninterrupted service;
Merchantability or fitness for a particular purpose.

Some jurisdictions may not allow full disclaimer of implied warranties; portions of this section may not apply to you.

18. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

Fun Park Go is not liable for any damages of any kind including, without limitation:

Personal injury
Death
Lost profits
Lost data
Loss of business or goodwill
Delays or cancellations
Missed flights or connections
Incorrect travel information
Advisor mistakes or omissions
Travel Provider acts, errors, or negligence
Emotional distress
Any indirect, special, incidental, or consequential damages

Your sole remedy for dissatisfaction with the Services is to stop using the Services.

19. ASSUMPTION OF RISK & RELEASE OF CLAIMS

Travel involves inherent risks, including illness, injury, accidents, wildlife encounters, weather conditions, political instability, and lack of immediate medical care.

By booking travel through Fun Park Go or a Fun Park Go Advisor, you voluntarily assume all such risks and release Fun Park Go from all related claims, except where prohibited by law.

20. INDEMNIFICATION

You agree to indemnify and hold harmless Fun Park Go, its owners, employees, contractors, and Advisors from any claims, losses, liabilities, or expenses (including attorney fees) arising out of:

Your use of the Services;
Your travel activities;
Your User Content;
Your violation of these Terms; or
Any interaction with Advisors or Travel Providers.

21. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.

Any legal action shall be brought exclusively in the state or federal courts located in Bonneville County, Idaho.

You waive any objection to this jurisdiction.

22. ARBITRATION (IF REQUIRED)

Fun Park Go may require disputes to be resolved by binding arbitration under Idaho law. If arbitration is required, you waive the right to a trial by jury.

23. LIMITATION ON TIME TO BRING CLAIMS

Any claim arising out of or relating to these Terms or the Services must be filed within one (1) year after the cause of action occurs. After that, the claim is permanently barred.

24. WAIVER & SEVERABILITY

Failure to enforce any provision of these Terms does not constitute a waiver. If any provision is found invalid, the remaining Terms remain in effect.

25. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any Advisor Agreements, are the complete agreement between you and Fun Park Go regarding the Services.
